TERMS OF USE AND SALE

These Terms of Use and Sale apply to the sale of products from the product range of Masterpiece d.o.o. Belgrade (hereinafter: the Seller) through the website www.lipocosmetics.rs.

Article 1 – Information about the Seller

Trade via the website www.lipocosmetics.rs is carried out by Masterpiece d.o.o. Belgrade, Ljubljanska 14, registration number: 20677295, PIB 106769879, activity code: 2042 – Production of perfumes and toilet preparations, contact e-mail: info@lipocosmetics.rs.

The store mentioned in paragraph 1 represents distance selling in accordance with the law.

Article 2 – Purchasing Procedure

Purchasing products sold through the website www.lipocosmetics.rs can be done as a guest purchase. This type of purchase means that the customer will be asked only for basic information needed for order delivery (name, surname, address, contact phone, contact email), choosing the payment method, and confirming the order. After completing the purchase process, the option to register as a user or continue as an unregistered user will be offered.

The customer can register as a user on the website www.lipocosmetics.rs by entering the required information (name, surname, address, contact phone, contact email), which will be stored in accordance with the law and the Seller’s privacy policy.

A registered user can make a purchase by logging into the system using their registration details (username and password), adding selected products to the cart, choosing the payment method, and confirming the order.

To make a purchase on the website www.lipocosmetics.rs, the customer may, but is not obligated to, have a user account registered via www.lipocosmetics.rs. A customer with a registered account, as well as a customer without a registered account, by submitting an order confirms that they are fully aware of and accept the Terms of Use and Sale on www.lipocosmetics.rs.

It will be considered that the agreement between the Seller and the Customer is concluded upon the confirmation of the order by the Seller.

Article 3 – Payment Method

Payment for an order placed through the website www.lipocosmetics.rs can be made via credit/debit cards, cash on delivery, or through a bank account (if the customer is a legal entity).

When entering payment card details, confidential information is transmitted over a public network in a protected (encrypted) form using the SSL protocol and PKI system, which are the most advanced cryptographic technologies currently available. The security of the data during the purchase is guaranteed by the payment card processor, Banca Intesa ad Belgrade, and the entire payment process is carried out on the bank’s website. At no point are

payment card details available to our system.

All payments will be made in the local currency of the Republic of Serbia – dinar (RSD). For informational purposes, prices in other currencies are displayed using the middle exchange rate of the National Bank of Serbia. The amount that will be charged to your payment card will be expressed in your local currency through conversion at the exchange rate used by the card organizations, which cannot be known to us at the time of the transaction. As a result of this conversion, there may be a slight difference from the original price displayed on our website.

An invoice will be sent to the customer with the order.

Article 4 – Prices

All prices displayed on the website www.lipocosmetics.rs are expressed in dinars and include VAT.

For all orders, the applicable prices are those at the time of payment confirmation.

The Seller reserves the right to change the current prices at any time.

Article 5 – Delivery

After the customer submits an order, the order processing status begins. During processing, a notification of successful purchase will be sent to the customer’s email address. This email contains the customer’s details provided during the ordering process.

In case of any uncertainties or issues related to the order, the Seller will contact the Customer without delay.

Delivery of goods ordered through the website www.lipocosmetics.rs is carried out through the Post Express courier service of the Serbian Post.

From the moment the order is confirmed, the delivery time is up to 10 business days.

For all orders with a value less than 9,000.00 RSD including VAT, the customer bears the delivery costs within the territory of the Republic of Serbia, according to the regular price list of the Post Express courier service valid on the day of the order, depending on the value and weight of the package. The Seller draws attention to the fact that when paying cash on delivery, the Customer will incur an additional cost for money transfer/ransom fee, which is paid to the Serbian Post or the courier service.

For orders with a value greater than 9,000.00 RSD including VAT, the customer does not bear the delivery costs.

The courier service delivers the package to the address specified by the customer in the order between 8 AM and 7 PM. On the day of delivery, the customer will receive a notification from the Serbian Post that the package has arrived and is expected to be delivered within the day. It is possible to specify a different delivery address from the customer’s residence, e.g., a work address. Deliveries are made on Saturdays if your post office operates on Saturdays. Delivery does not occur on Sundays.

If the customer does not pick up the package, it will be held at their post office for the next 5 days without storage fees.

If the customer does not pick up the package, it will be returned to the Seller’s address.

The customer can check the status of the shipment by entering the PE number they receive in the search on the Serbian Post website under “Track a Shipment.”

Article 6 – Conformity of Goods

All goods sold through the website www.lipocosmetics.rs possess the properties necessary for regular use of that type of product in accordance with its intended purpose as defined in the declaration, which is listed on the relevant page next to each product.

The Seller is obliged to deliver goods to the Consumer that conform to the contract.

The conformity of goods to the contract is determined exclusively based on the properties and purpose of the goods as defined in the corresponding declaration.

Article 7 – Product Availability

The Seller makes constant efforts to ensure that the product offering displayed on the website www.lipocosmetics.rs is always up to date. However, due to market dynamics and changing demand for products, there is a possibility that in certain cases, the ordered product may no longer be available in the Seller’s warehouse at the requested time. If such a situation occurs, the Seller’s sales service is obligated to inform the customer via email and contact them by phone regarding the possible timeframe for securing the product and its delivery.

Article 8 – Complaints and Product Replacement

The Consumer has the right to file a complaint with the Seller to exercise their rights based on the conformity of the goods, incorrectly calculated prices, and other defects, in accordance with the procedure provided in the Terms of Use and Sale.

The Consumer has the right to make a complaint as soon as they discover the lack of conformity of the goods, but no later than the “Use by:” date marked on the product.

If the lack of conformity occurs after a period of 6 months from the moment the risk passed to the Consumer, the burden of proof shifts to the Consumer, who must prove that the goods were non-conforming at the moment the risk was transferred, by providing appropriate evidence.

All costs necessary to bring the goods into conformity with the contract, especially labor, material, retrieval, and delivery costs, are borne by the Seller.

The replacement must be made within the legal period of 14 days from the day of receipt of the shipment.

In case of deviation from the specified specifications or a defect, the Seller is obliged to replace the product with a functional one, and all costs will be borne by the Seller.

If replacement is not possible, the Seller is obliged to refund the money to the customer, and the customer will bear the return shipping costs.

Any damage during transport, visible on the product’s packaging, must be reported by the customer immediately to the courier who delivered the goods, as well as to the Seller within 24 hours of receiving the goods.

If, after receiving the shipment, the buyer determines that the delivered goods do not correspond to the ordered goods or the data on the invoice are not appropriate, he is obliged to inform the Trader about the defects within 24 hours from the moment of receipt of the shipment, via the e-mail address info@lipocosmetics.rs, or to deliver to the Trader a completed complaint form to the Trader’s address: Masterpiece d.o.o. Belgrade, Petra Škundrića 3, 11000 Belgrade with the indication ‘Lipo Claim’.

After receiving the complaint, the Seller will confirm receipt and inform the customer of the next steps.

The deadline for a response to a complaint is 8 days, and the resolution of the complaint must occur within 15 days from the moment it is filed.

The complaint form is available on the website www.lipocosmetics.rs.

The product can be replaced within the legal period, provided it is not damaged or used, and the customer will bear the return costs. The customer may or may not specify the reason for the replacement.

Article 9 – Withdrawal from the Contract

The customer has the right to withdraw from the contract concluded at a distance.

The withdrawal period is 14 days from the day of delivery of the goods, without providing a reason.

By withdrawing from the contract, the customer is released from all obligations, except for the obligation to pay all costs related to the sending and returning of goods that are returned due to withdrawal from the contract (costs of sending such goods from the seller to the customer after the order, as well as from the customer to the seller when returning them).

The customer may exercise the right to withdraw from the contract by submitting a statement, which can be made using the special withdrawal form for contracts concluded at a distance or off-premises, or in any other unambiguous manner.

The withdrawal form can be found on the website www.lipocosmetics.rs.

The customer is obliged to submit a completed and signed form of declaration of withdrawal from the contract to the Trader at the e-mail address info@lipocosmetics.rs or to deliver it by mail to the Trader’s address Masterpiece d.o.o. Belgrade, Petra Škundrića 3, 11000 Belgrade with the indication ‘Withdrawal from the contract LIPO’.

When returning the goods, they must be returned in proper, unused condition and in the original, undamaged packaging, with the original fiscal receipt attached.

Article 10 – Refund

The customer who has withdrawn from the contract in accordance with these terms will be refunded after the product’s condition has been verified, to the customer’s bank account provided in the Withdrawal Statement.

The Seller is obligated to refund the amount paid by the customer under the contract, no later than 15 days from the receipt of the returned product by the customer who has withdrawn from the contract. If the product being returned due to withdrawal from the contract was paid with a payment card, either partially or fully, the funds will be refunded to the cardholder’s account.

In the case of returning goods and refunding to a customer who previously paid with a payment card, partially or fully, regardless of the reason for the return, Masterpiece d.o.o. is obligated to make the refund exclusively via VISA, EC/MC, Maestro, Amex, and Dina payment methods, which means that the bank

will carry out the refund to the cardholder’s account upon the seller’s request.

The costs of returning goods and funds are borne by the customer.

Article 11 – User Privacy Protection

On behalf of Masterpiece d.o.o., we commit to protecting the privacy of all our customers. We collect only the necessary basic data about customers/users and data required for business operations and informing users in accordance with good business practices and with the aim of providing quality service. We give customers the option to choose, including the option to decide whether or not they want to be removed from mailing lists used for marketing campaigns. All user/customer data is strictly protected and is only accessible to employees who require that information to perform their duties. All employees of Masterpiece d.o.o. (and business partners) are responsible for adhering to the principles of privacy protection.

Article 12 – Intellectual Property

All content (texts, images, and other materials) found on the website www.lipocosmetics.rs is the intellectual property of the Seller or third parties from whom the Seller has obtained consent to use it.

Any use of the content of the website www.lipocosmetics.rs for commercial or other purposes without the explicit consent of the Seller is prohibited.

Article 13 – Final Provisions

For all matters related to the sale of goods through the website www.lipocosmetics.rs that are not regulated by these Terms of Use and Sale, the applicable laws of the Republic of Serbia will apply.

The contractual parties will strive to resolve any potential disputes amicably, and if that is not possible, such disputes will be resolved before the competent court in Belgrade.

The Seller reserves the right to change these Terms of Use and Sale without prior notice, with the publication on the website www.lipocosmetics.rs.
